Booking Terms and Conditions

Welcome to Villa Fico d’India. By making a reservation at our property, you agree to the following terms and conditions.

1. Reservation and Confirmation

Your reservation is considered confirmed only after payment has been made through the secure Stripe payment system. You will receive a confirmation email with all the details of your reservation.

2. Check-in and Check-out

• Check-in: 3:00 PM to 9:00 PM
• Check-out: 8:00 AM to 11:00 AM
• For late arrivals, please contact us at least 24 hours in advance
• A valid form of identification is required at check-in for each guest

3. Payment

Payment is required at the time of online booking. We accept all major credit and debit cards via Stripe.

4. Guests

The maximum number of guests is 8. Additional guests are not permitted without prior written authorization. Minors must always be accompanied by an adult.

5. Internal Regulations

• Smoking is prohibited inside the building.
• Pets are allowed upon request and with prior approval.
• Please be quiet between 11:00 PM and 8:00 AM out of consideration for your neighbors.
• Please treat the facilities, furniture, and equipment with respect.
• Report any damage immediately.
• The pool is for the exclusive use of the villa's guests.

6. Damages and Liability

Guests are responsible for any damage caused to the property or furnishings. In the event of damage, we reserve the right to charge the amount necessary for repair or replacement.

This policy describes how we collect, use, and protect your personal data in accordance with the General Data Protection Regulation (GDPR).

2. Types of Data Collected

• Information provided voluntarily: First name, last name, email address, phone number, dates of stay, number of guests, and messages sent via the booking form.
• Automatically collected data: IP address, browser and device type, pages visited, session duration, technical cookies.
• Payment information: Collected and managed directly by Stripe Inc.; the website does not process or store this information.

No special categories of personal data as defined in Article 9 of the GDPR are collected.

3. Purpose and Legal Basis

1. Management of reservations and contractual relationships: performance of a contract (Art. 6(1)(b) of the GDPR).
2. Response to contact requests: legitimate interest of the data controller (Art. 6(1)(f) of the GDPR).
3. Tax and accounting obligations: legal obligation (Article 6(1)(c) of the GDPR).
4. Service communications regarding your stay: performance of a contract (Art. 6(1)(b) of the GDPR).

4. Methods of Processing

The data is processed using IT tools in accordance with the principles of lawfulness, fairness, transparency, data minimization, and security as set forth in the GDPR. The processing is carried out directly by the Data Controller. The data is not subject to automated decision-making or profiling.

5. Data Retention

• Reservation and contract data: 10 years from the end of the relationship, in compliance with tax requirements.
• Contact information without a reservation: 12 months from the last communication.
• Browsing data and technical cookies: up to 13 months.

6. Disclosure of Data

Personal data is not sold or disclosed to third parties. It may be disclosed exclusively to:

• Public authorities (Police Headquarters, Internal Revenue Service) in cases provided for by law, including the obligation to report attendance pursuant to the Consolidated Law on Public Security (T.U.L.P.S.)
• Providers of strictly necessary technical services (hosting providers), who act as data processors pursuant to Article 28 of the GDPR.
• Stripe Inc., limited to the data necessary for transactions. Stripe is PCI-DSS certified. Stripe's Privacy Policy.

7. Rights of the Data Subject

Pursuant to Articles 15–22 of the GDPR, you have the right to:

• Access: Obtain a copy of your data (Art. 15).
• Correction: Correcting inaccurate data (Section 16).
• Cancellation: Request cancellation in the cases provided for (Art. 17).
• Restriction: Request a restriction on processing (Art. 18).
• Data portability: Receiving data in a machine-readable format (Art. 20).
• Objection: Object to processing based on legitimate interests (Art. 21).
• Complaint: File a complaint with the Italian Data Protection Authority at garanteprivacy.it.

3. You will receive confirmation of your cancellation within 48 hours

05 — Liability

Disclaimer

Villa Fico d’India is covered by a standard liability insurance policy, which includes specific coverage for vacation rentals.

The operator assumes no liability for:

• Damage to, theft of, or loss of guests’ personal belongings not directly attributable to the operator’s negligence.
• Service disruptions caused by force majeure events (power outages, external failures, adverse weather conditions, etc.).
• Injuries resulting from the improper use of the premises, furnishings, swimming pool, or equipment.
• Damage caused by guests or third parties invited by them failing to comply with the rules.

Guests are personally liable for any damage caused to the property during their stay. Any damage found at checkout will be documented and must be compensated.
